These Terms of Service ("Terms") govern your use of Tornads ("we", "us", "our"), available at tornads.ai (the "Service"). By using the Service, you agree to these Terms.

1. Description of the Service
Tornads is an AI-powered video creation platform. Users provide product information and media (images, videos, logos) and the Service generates short-form video ads, AI-generated video shots, and avatar-based videos. The Service includes tools for scripting, voiceover generation, captioning, and video editing.
2. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate and complete information
- Keep your login credentials confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activity that occurs under your account
You must be at least 13 years old to use the Service. If you are between 13 and 16, you may need parental consent under applicable law.
3. Subscriptions and Payments
3.1 Pricing
The Service offers free and paid plans. Paid plans are billed on a recurring basis (monthly or annually) as described on our pricing page. Prices are displayed inclusive of applicable taxes.
3.2 Payment Processing
Payments are processed by Stripe. By subscribing to a paid plan, you agree to Stripe's terms of service. We do not store your payment card details.
3.3 Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period. We do not offer prorated refunds for partial billing periods.
In accordance with French consumer law (Article L221-28 of the Consumer Code), you acknowledge that by using the Service to generate content, you expressly request that performance begins before the end of the 14-day withdrawal period and waive your right of withdrawal for any content already generated.
4. Acceptable Use
You agree not to use the Service to:
- Create content that is illegal, defamatory, obscene, or infringes on the rights of others
- Upload media you do not have the right to use (including copyrighted material without authorization)
- Generate misleading, deceptive, or fraudulent advertisements
- Attempt to reverse-engineer, decompile, or extract the source code of the Service
- Abuse the Service through automated scripts, bots, or excessive API calls
- Resell, sublicense, or redistribute access to the Service without our written permission
- Interfere with the security or integrity of the Service
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
5. Intellectual Property
5.1 Your Content
You retain ownership of all media you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process, store, and display it solely for the purpose of providing the Service to you.
5.2 Generated Content
You own the videos and creative assets generated by the Service using your inputs. You are free to use, modify, and distribute generated content for any lawful purpose, including commercial use.
5.3 Our Intellectual Property
The Service, including its software, design, templates, branding, and documentation, is owned by Tornads and protected by applicable intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or proprietary technology beyond what is necessary to use the Service.
6. AI-Generated Content Disclaimer
The Service uses artificial intelligence to generate content. AI outputs may not always be accurate, appropriate, or suitable for your intended purpose. You are solely responsible for reviewing, editing, and ensuring the suitability of any content generated by the Service before using or publishing it.
7. Availability and Modifications
We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. We will make reasonable efforts to notify you of material changes that affect your use of the Service.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
- Our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim
- We are not responsible for content you create, publish, or distribute using the Service
Nothing in these Terms excludes liability that cannot be excluded under French law, including liability for gross negligence or willful misconduct.
9. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice, except in cases of serious violation where immediate termination may apply.
Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days, subject to legal retention obligations.
10. Governing Law and Disputes
These Terms are governed by the laws of France. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent French courts.
In accordance with EU Regulation No. 524/2013, you may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
